Litigation in the United States of America

B. Cremades & Asociados has extensive experience in legal proceedings before courts in the United States of America, as several of the frm’s lawyers are admitted to practice in U.S. jurisdictions (New York, District of Columbia, California and Illinois).

In addition, some members of the team have years of experience practising in U.S. offices of U.S. law frms.

The lawyers of B. Cremades & Asociados represent clients in legal proceedings in the United States (with or without the assistance of local counsel). The team regularly assists U.S. firms in cases involving cross-border disputes, international law and/or foreign parties, including sovereign States.

The lawyers of B. Cremades & Asociados have appeared before various state trial and appellate courts, as well as U.S. federal district courts, U.S. Courts of Appeal and the U.S. Supreme Court. The team’s U.S. experience spans a wide range of matters, including corporate, labour and employment, commercial, and class action litigation. B. Cremades & Asociados has handled motions, discovery (including e-delivery and depositions), mediations, settlement conferences, national arbitrations, jury trials and appeals.

Among the cases in which B. Cremades & Asociados has participated is the recovery of artwork stolen by the Nazi regime. In this regard, B. Cremades & Asociados has participated, on behalf of the Federation of Jewish Communities of Spain and the Jewish Community of Madrid, in the litigation between the Cassirer family and the Thyssen-Bornemisza Foundation regarding the painting “Rue Saint-Honoré in the Afternoon. Rain Efect” (1897) by Camille Pissarro. B. Cremades & Asociados’ involvement in this case extends to all levels of the federal judicial system, including the Supreme Court of the United States.

B. Cremades & Asociados also has experience in the enforcement of enforceable titles in the United States. This experience includes petitions for the recognition and enforcement of foreign arbitral awards, including awards against sovereign States and governmental entities. Consequently, the lawyers of B. Cremades & Asociados are highly familiar with the U.S. Federal Arbitration Act (FAA) and the Foreign Sovereign Immunities Act (FSIA).

Finally, B. Cremades & Asociados also has experience in U.S. discovery proceedings. For example, the firm has participated in 28 U.S.C. Section 1782 proceedings to obtain discovery in the United States for use in foreign and international courts. In this regard, the firm worked closely with U.S. counsel to obtain the first successful application for discovery under Section 1782 for use in Spanish court proceedings. In addition, B. Cremades & Asociados executed an order from the U.S. District Court for the Southern District of New York in Spain against a company listed on the Spanish stock exchange for the production of thousands of documents for use in a U.S. lawsuit.
